A Family Member Has Been Arrested

If someone you care about is in police custody, call Peter Bonner & Co on our 24-hour number 020 8297 1727. We can help arrange independent legal advice and explain the practical next steps.

Information that helps us act

Give us their name, date of birth if known, the police station, the time of arrest and any reference or officer’s details. You do not need to know the full allegation before making an enquiry. Ask custody staff to record that Peter Bonner & Co has been requested. The person detained should ask for a solicitor before answering questions.

Independent legal advice at the police station is free regardless of income. It is the detained person’s choice of solicitor; a relative can help make contact, but cannot give their account or interview instructions on their behalf.

Health, welfare and children

Tell custody staff immediately about medication, disability, mental-health concerns, language or communication needs. Give accurate information about treatment and any urgent welfare concern. Do not assume the station already knows their medical history.

Children and vulnerable adults may need an appropriate adult. That person supports understanding and welfare; the solicitor advises on the allegation and the law. A parent may be suitable, but another person may be required depending on the circumstances. Read our youth defence page.

What we can explain

We can contact the police, seek available information and advise the client privately before interview. We can explain release, bail or charge when the position is known. Arrest does not mean conviction, and there is no single release time that applies to every detention.

Keep your phone available and preserve any potentially relevant material. Avoid discussing the allegation with complainants or witnesses, and do not publish case details on social media.

Frequently asked questions

Will the police tell me everything?

Not necessarily. Confidentiality, the investigation and the detained person’s wishes can limit information disclosed to relatives. We also need authority before sharing confidential advice.

Can I sit in the interview?

Not simply because you are a relative. An appropriate adult may attend where required. We explain the arrangements for the individual case.

Can they ask for Peter Bonner & Co?

Yes. They should tell custody staff that they want us as their solicitor. Contact us directly as well where possible.

What happens after release?

Read our guidance on pre-charge bail and release under investigation. If charged, obtain advice promptly about the first hearing.
